We strive to provide accurate descriptions and images of our products to help you make informed decisions.

These terms and conditions outlined below form the basis of the mutual relationship between you ("you") and our platform (Soireedechic). This relationship is a legally binding agreement between you and us. By "you," we mean any user, customer, designer, operator, tailor, or delivery company; and by "we" or "our," we mean Soiree de Chic Company.

1. Introduction

2. By using our platform, you fully accept these terms and conditions; accordingly, if you do not agree to these terms and conditions or any part of them, you may contact our platform management, or you should not use our platform.

3. If you [register on our platform, or submit or provide any materials on our platform or use any of our platform services], we will require you to explicitly agree to these terms and conditions and any subsequent amendments.

4. Our platform uses cookies; by using our platform or agreeing to these terms and conditions, you consent to our use of cookies in accordance with the terms of our [Privacy Policy].

5. Your acceptance of these terms and conditions is considered an authorized electronic signature signed in our electronic system, confirming the validity of the agreement and the terms and conditions, in accordance with the provisions of Law No. 20/2014 concerning electronic transactions.

2. Copyright:

1. This platform is owned by Soiree de Chic Company, which holds the copyright to all materials and information displayed on this platform.

2. Subject to the explicit provisions of these terms and conditions:

 2.1 We own and control all copyright and other intellectual property rights in our platform and the materials available on it.

 2.2 All copyright and other intellectual property rights in our platform and the materials available on it are reserved.

3. You are prohibited from doing the following: 

3.1 Copying, recording, modifying, altering, or translating any part of the " Soiree de Chic" platform, including, but not limited to, attempting to remove or modify in any way any names, labels, logos, or trademarks found on the " Soireedechic" platform. 

3.2 Damaging or diminishing in any way our intellectual property rights, and you must make every effort to protect our intellectual property rights from infringement by third parties.

3. License for Use

1. You may:

• View the pages of our platform.

• Download pages from our platform for temporary storage.

• Print pages from our platform.

• Use the services of our platform, subject to the other provisions of these terms and conditions.

2. Except as expressly permitted in these terms and conditions, you must not download any material from our platform or save any of this material on your device.

3. You may only use our platform for your personal use, and you must not use it for any other purposes.

4. Except as expressly permitted under these terms and conditions, you must not modify or alter any design on our platform except to the extent that it is available on our platform and expressly allowed under these terms and conditions.

5. Unless you own or control the relevant rights in the design, you must not do the following:

• Republish the design from our platform (including republishing on another platform).

• Sell, rent, or sublicense the design from our platform.

• Display any materials from our platform to the public.

• Exploit the design from our platform for commercial purposes; or redistribute the design from our platform.

4. Acceptable Use

1. You are prohibited from:

   • Using any type of web spider, virus, worm, Trojan horse, time bomb, or any other code or instructions designed to distort, delete, destroy, or disrupt the " Soiree de Chic" platform, communication system, or any company-related system.

   • Accessing our platform or interacting with it in any other way using any robot, spider, or other automated means.

   • Using our platform in any illegal, fraudulent, or harmful manner, or in connection with any illegal, fraudulent, or harmful purpose or activity.

   • Engaging in any systematic or automated data collection activities, including but not limited to scraping, data extraction, and data collection, on our platform or in relation to it without our explicit written consent.

   • Using data collected from our platform for any direct marketing activities, including but not limited to email marketing, SMS marketing, telemarketing, and direct mail.

   • Using data collected from our platform to contact individuals, companies, or other entities.

   • Using our platform to copy, host, transmit, use, publish, or distribute any material consisting of or related to any spyware, viruses, Trojan horses, worms, keyloggers, rootkits, or other malware.

   • Conducting abusive business practices.

• Using our platform in any way or taking any action that causes damage to the platform or adversely affects its performance, availability, or accessibility, including but not limited to:

2. You must ensure that all information you provide to us through our platform, or in relation to our platform, is correct, accurate, current, complete, and not misleading.

5. Creating an Account on the Platform

1. You can shop on the platform without creating an account, but the terms and conditions will apply to you.

2. To be eligible for an individual account on the platform, you must be at least 18 years old.

3. You can register for an account on the platform by completing and submitting an account registration form, and clicking on the validation link in the email that will be sent to you from the platform or in a message to your mobile number.

4. You must not allow anyone else to use your account to access the platform.

5. You must notify us in writing immediately if you become aware of any unauthorized use of your account.

6. You must not use another person's account to access the platform unless that person has expressly authorized you to do so.

7. The privacy policy applies to the personal data provided on the platform.

8. If you forget your password, please use the "Forgot Password" feature on the login page and follow the instructions provided.

6. Account Closure

1. Multiple accounts for the same person are not allowed; violating this clause may lead to account closure.

2. If the platform is used, damaged, disrupted, or any unauthorized act is conducted illegally, this may lead to account closure. This includes using the platform for illegal, abusive, dangerous, or harmful purposes, resulting in account closure and full responsibility for any consequences arising from it.

7. Buyer/Customer Terms

1. The buyer is fully responsible for providing correct data and measurements. The platform is not responsible for errors resulting from incorrect information entered.

2. The buyer agrees to provide accurate personal details and banking information when making payments, and must use a valid payment card. The platform reserves the right to reject any transactions lacking accuracy or validity.

3. The buyer is responsible for reviewing the size guide and details available on the platform to avoid discrepancies in orders.

8. Terms for Designers, Operators, and Tailors

1. They must complete the order fully according to the measurements specified by the customer from the date of receiving the order details until the product is delivered to the delivery company.

2. They are obligated to fulfill the order within a period not exceeding fourteen days from the date of receiving the order and confirming payment.

3. The designer, operator, and tailor commit to not accepting any orders related to the agreed designs in this contract outside the platform's scope, and they must exclusively submit all orders through the platform as the sole means for these requests.

9. Terms for the Delivery Company

1. The delivery company is obligated to send an email to the customer including the shipment date of the item and must ensure the safety of the shipment, providing adequate care for timely delivery without delay.

10. Exchange and Refund Policy

1. Soiree de Chic undertakes to inspect all products to ensure their quality and condition prior to shipment. In the event that a customer receives a product with damage not identified during the inspection process, the customer is required to notify the company via the designated official email within 24 hours of receipt of the order. Upon verification that the damage was not caused by the customer, the company shall bear all shipping costs associated with the product replacement. The customer must provide sufficient proof of the damage within the specified period to preserve their right to a replacement.

2. If the design matches the specifications and measurements provided by the customer in the order details, no exchanges or refunds are permitted under any circumstances.

3. The customer has the right to request one free modification on the items, such as shortening or tightening. If expansion or any additions (such as fabric) are requested, additional fees will be charged based on those additions after approval.

4. The items to be exchanged or returned must be in their original condition at the time of purchase, free from any odors or fragrances, and must include the clothing tag or attached label. Requests for exchange or return will not be accepted without meeting these conditions.

5. To request an exchange or refund, the customer must contact the platform via the company's WhatsApp at +965 94412291 or the company's email at soiredechic@gmail.com  after approval, the exchange or refund will be processed through a visit to the store to verify the condition of the items, within 24 hours of receiving them for evening wear and special occasion clothing. If the return request is approved, the refund will be issued to the customer within 14 days after confirming the condition of the item, and the refunded amount will be deposited back to the same account.

This policy aligns with the decisions made by the Ministry of Commerce and Industry regarding the consumer's right to exchange and refund goods, which allows for exchanges or refunds within 14 days from the purchase date indicated on the invoice. The law excludes high-value items such as jewelry, watches, glasses, evening wear, wedding attire, items that touch the skin (such as swimwear and underwear), and perfumes, allowing for an exchange or refund period of only one day, provided the option is noted on the purchase invoice, with all items remaining in their original condition.

11. Disclaimer

1. You acknowledge that the platform is not legally or contractually responsible for any violation or infringement by you of any legal or contractual obligation or intellectual property rights or copyright, and you agree to indemnify the platform against any claims arising from this by third parties, including all expenses and fees, such as actual attorney's fees.

2. The customer bears all shipping and delivery costs, and Soiree de Chic Company bears no financial responsibility in this regard.

3. The platform is responsible for delivering the items from the operator and tailor to the customer in agreement with the delivery company unless otherwise agreed.

4. The platform, operator, and tailor are not responsible for any delay in delivering the item if the cause of the delay is due to the delivery company.

5. We are not responsible if the customer provides incorrect measurements and the design is executed based on those measurements.

6. We do not guarantee the availability of the fabrics required for the selected design due to high demand, which may lead to automatic updates in the database and unavailability of the design in the chosen fabric.

7. We disclaim responsibility for any issues the customer may face due to allergies to fabric types, as the type of fabric is specified in the description attached to each item.

12. Payment Methods

1. Payments are made through the website using approved payment methods, and cash on delivery is not accepted.

2. When the customer selects an electronic payment method, the payment is processed through the service provider associated with the platform, MY FATOORAH. MY FATOORAH will retain your credit card information for processing future payments. Please note that Soiree de Chic does not retain your credit card information or payment details.

3. The customer must ensure sufficient funds are available on their credit card or debit card when placing an order. The platform will reasonably attempt to resolve issues related to payments made through it, including refunds, fees, cancellations, and dispute resolutions, as long as they are reasonable and justified according to these terms and at the discretion of the platform.

4. All payments are made in Kuwaiti Dinar, and international transfers are subject to exchange rates.

5. During the payment process, you can pay using "KNET," "MasterCard," "Visa," or any other method provided by the platform, and you will be directed to a secure payment page.

13. Breach of These Terms and Conditions

1. Without prejudice to our other rights under these terms and conditions, if you breach these terms in any way, or if we reasonably suspect that you have breached these terms in any way, we may:

• Send you one or more formal warnings.

• Temporarily suspend your access to our platform.

• Permanently ban you from accessing our platform.

• Block computers using your IP address from accessing our platform.

• Contact any of our internet service providers and request that they block your access to our platform.

• Initiate legal action against you for breach of contract or otherwise.

• Suspend or delete your account on our platform.

2. When we suspend or ban your access to our platform or any part of it, you must not take any action to circumvent such suspension or ban, including but not limited to creating and/or using a different account.

14. Changes

1. We may review and amend these terms and conditions from time to time.

2. The amended terms will apply to your use of our platform from the date the revised terms and conditions are published on the platform and from the date you receive electronic notice of the new amendments. You hereby waive any right you may have to be notified of or consent to changes to these terms and conditions. If you do not agree to the amended terms, you may contact the platform management, or you may stop using our platform.

15. Severability

1. If any provision of these terms is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will remain in effect.

2. If any part of any provision of these terms is determined by any court to be unlawful and/or unenforceable unless that part is removed, that part will be deemed deleted, and the remainder of that provision or clause will remain in effect.

16. Third Party Rights

1. The provisions set forth are for our benefit and your benefit, and are not intended to benefit or be enforceable by any third party.

2. The exercise of the rights of the parties under these terms is not subject to the consent of any third party.

17. Entire Agreement

These terms and conditions, together with our privacy policy, constitute the entire agreement between you and us regarding your use of our platform and supersede all prior agreements between you and us regarding your use of our platform.

18. Governing Law and Jurisdiction

These terms are governed by and construed in accordance with [Kuwaiti law], and the Kuwaiti courts will have exclusive jurisdiction to settle any dispute arising out of these terms and conditions.
